Fence Maintenance Policy

 

Background

The Montrachet and Chambord communities include various fences that border Common Areas (as the term “Common Area is defined in the CC&Rs).  From time to time the issue of repair and maintenance of these fences may need to be addressed.  These fences fall into three categories:

 

Category

 

1

Fences build by the developer, which separate private lots from Common Areas

2

Fences parallel to 244th Ave. SE on Lots 21,22, 32 and 33 built by and funded by Homeowners as required by Article 3.6.17 of the CC&R.

 

3

Fences built by homeowners at their expense and without financial participation of the association.

 

 

 

Policy

In order to insure consistency and fairness, the Board of Directors has defined the following policy for the maintenance and repair of fences:

 

For all fences included in categories (1) and (2) above:

·        The Association and applicable homeowner are each responsible for maintenance of the side of the fence facing their property.

 

·        Any damage to the fence caused by acts of the Association or homeowner will be repaired by and at the expense of the damaging party. 

 

·        Repair of damage caused by an act of God such as wind, rain, hail, falling trees, etc, will be shared equally by the Association and the affected homeowner.  This liability may be covered by a homeowner’s insurance.

 

For all fences in category (3) above:

·        The Association shall have no responsibility for the maintenance or repair of these fences unless damage is cause by an act of the Association or an agent of the Association
